Delivery Terms in Brief:
1. ProMart is a wholesale company, and we sell products to business customers on account. Consumers can purchase our products from our stores, where payment by bank card is accepted. We do not accept cash.
2. Products in stock have a delivery time of 1–5 business days. If an ordered product is exceptionally out of stock, the customer will be notified without delay.
3. If the customer has received the wrong product, or the product is defective, the customer must notify a ProMart Oy sales representative or customer service without delay, either by email at asiakaspalvelu(at)promart.fi or by phone (weekdays 8 AM–4 PM).
4. ProMart Oy is not liable if the delivery of an order is prevented, hindered, or delayed due to circumstances beyond ProMart Oy’s control, such as war, natural disaster, export or import restrictions, decisions by authorities, disruption of public transport, or any other similar circumstance that hinders or prevents ProMart Oy’s operations.
Detailed Delivery Terms
1.1 Delivery Time
(1) ProMart delivers products included in its stock selection within 1–5 days from the date of the order.
(2) ProMart delivers automatically replenished products within one week on the agreed weekly delivery day of the week following the order, unless otherwise agreed by the parties.
1.2 Delay
As soon as ProMart becomes aware of a delay, it is obligated to notify the customer, stating the reason for the delay and the estimated new delivery date. If the manufacturer of the product, or the party from whom ProMart acquires the product, has not fulfilled its agreement and ProMart’s delivery is delayed as a result, ProMart is not obligated to compensate the customer for any damage that may result from this.
If the product is not delivered, or is delivered too late, and this is not due to the customer or a circumstance on the customer’s side, the customer is nevertheless not entitled to demand delivery if circumstances have changed in a way that materially alters the relationship of the originally agreed performance obligations.
If the delay is due to ProMart’s negligence, the customer may claim compensation for direct damages proven by the customer. Unless otherwise agreed, the amount of compensation is a maximum of 0.5% of the value of the delayed delivery for each full week following the delivery date. However, the total amount of compensation may not exceed 7.5% of the value of the delayed delivery.
1.3 Transfer of Risk
The risk passes to the customer when the product is delivered to the customer or to an independent carrier in accordance with the agreement.
If the product is not delivered on time and this is due to the customer or a circumstance on the customer’s side, the risk passes to the customer when ProMart has done what is required of it under the agreement to enable delivery.
1.4 Warranty and Suitability for Intended Use
The sold product is covered by the manufacturer’s warranty terms unless otherwise agreed. ProMart will, together with the Customer, select a product that is as suitable as possible for its intended use. The customer is responsible for the accuracy of the information provided to ProMart regarding the intended use of the product.
2. Pricing
Product prices are determined according to ProMart’s separate customer-specific price list. Value added tax applicable at the time is added to the prices. For products not included in the price list, product group-specific discount percentages have been defined.
If payment is delayed, compensation for the delay period will be charged according to the interest rate applied by ProMart at the time, starting from the due date stated on the invoice. ProMart also has the right to charge reasonable collection costs.
ProMart reserves the right to revise prices if exchange rates, import charges, or other fees, taxes, or other public charges beyond the supplier’s control change before the customer’s payment is made, or if the raw material or manufacturing costs of the product increase significantly. In connection with price revisions and possible increases, ProMart will, where possible, propose substitute products with similar features, or the customer may notify that they wish to discontinue ordering the product without any notice period.
3. Delivery Methods and Transfer of Ownership

Ownership of the product transfers to the customer once the full purchase price has been paid to ProMart, unless otherwise specifically agreed.
4. Payment Terms and Invoicing Fee
ProMart invoices the customer in accordance with the agreed invoicing method and the billing address information provided by the customer, once per agreed billing period. The payment term is 14 days unless otherwise agreed by the parties.
If an invoice is not paid by the due date, and this is not due to ProMart, ProMart has the right to delay further deliveries until the overdue payments have been made or acceptable security has been provided. ProMart also has the right to withhold deliveries if, based on the customer’s notice or otherwise, it is obvious that the customer’s payment will be substantially delayed. The customer is not entitled to make any claims for compensation arising from such delay.
We charge an invoicing and handling fee of €3 per consolidated invoice.
The payment processing service and payment service provider is Paytrail Oyj (2122839-7) in cooperation with Finnish banks and credit institutions. Paytrail Oyj will appear as the payee on your bank statement or card invoice and will forward the payment to the merchant. Paytrail Oyj is licensed as a payment institution. In the event of complaints, we ask that you primarily contact ProMart.
5. Right of Return and Complaints
When a consumer purchases products, the consumer has a 14-day right of return. The returned product must be unused and unaltered, and the packaging must be in flawless condition in order for the product price to be refunded to the customer. The return must include all parts, accessories, and any additional items. Any delivery charges will not be refunded in the event of a return. The consumer customer is responsible for the return costs and return shipment. To exercise the right of return, the customer must notify ProMart customer service in advance. The return must be made without delay. Failing to collect a package or returning it without separate notice is not sufficient to cancel the purchase.
If the delivery is defective in any respect, the customer must notify ProMart in writing of the defect within eight (8) business days from the delivery date. ProMart has the primary right either to correct the defect or to deliver a new product. The customer is not entitled to demand delivery if circumstances have changed in a way that materially alters the relationship of the originally agreed performance obligations.
6. Damages
ProMart is not obligated to compensate the customer for indirect damages caused by delay or delivery errors, such as production losses, lost profits, or other consequential financial losses.
ProMart’s liability for damages toward the customer is quantitatively limited to the amount of each individual delivery made to the customer.
7. Liability for Damage Caused by the Product
Once the product is in the customer’s possession, ProMart is not liable for damage caused by the product that affects:
(i) real or movable property, or is a consequence of such damage;
(ii) a product manufactured by the customer or a product containing a product manufactured by the customer
(3) This limitation of liability does not apply if ProMart has been guilty of gross negligence.
(4) If a third party presents a compensation claim to the customer or ProMart based on this section, the other party must be notified immediately in writing.
